Terms and conditions
Timelessphotoshoot.com, with registered office at Via Segantini – Latina – 04100 Italy, VAT No. 03077740599, hereinafter referred to as the “Platform,” and the User, identified through the credentials provided at the time of purchasing the service on the Platform, enter into the following contract electronically. Acceptance of this contract occurs by ticking the “I accept terms of service and privacy policy” checkbox, made available at the time of purchasing the service on the Platform.
Premise
To access the Platform, the user must register in order to use all functionalities, such as modifying purchases, viewing order summaries, and more. To register and create an account, the user must enter their first and last name, email address, and set a password in the “Customer Information” section displayed during the process of booking a photography service. This information must be kept confidential to ensure that no one else can access the user’s account. The user can change their password, update the information provided, and modify their booking at any time by accessing the platform through the login button located in the website footer (both on web and mobile).
Art. 1 – Object of the Contract
The User can choose the desired service directly on the Platform at the time of booking.

Art. 2 – Purchase and Payment Methods
The purchase of the Service is conducted exclusively online through the Platform, subject to the User’s registration and acceptance of this agreement, both of which take place during the purchase process in the ‘Customer Information’ section. The Service price is clearly indicated at the time of selection and may vary depending on the type of photography service chosen, the city, and the duration of the Service. Payment is made through the payment methods accepted by the Platform (e.g., credit card, PayPal). Payment confirmation constitutes final acceptance of the Service booking.
Art. 3 – Modifications and Cancellations
3.1 The User may cancel service contracts only in accordance with the cancellation conditions stated in the activity description on the Platform.
3.2 To avoid misunderstandings, the User must make modifications (e.g., rescheduling the activity date) and cancellations via the Platform, unless otherwise agreed upon.
3.3 Cancellations can be made by sending an email to info@timelessphotoshoot.com. Modifications or cancellations must be made in a timely manner. “Timely” is determined not only by the specific case (e.g., within the applicable cancellation period) but also by the availability of the activity. Therefore, it is crucial to read all conditions carefully. The decisive factor for timely cancellation is the receipt of the notification by timelessphotoshoot.com within the established deadlines. If these conditions are met, we will issue a cancellation or modification confirmation, which serves as proof and must be retained.
3.4 A cancellation (Exclusion of the Right of Withdrawal under Italian Law Article 59 “Codice del Consumo”) communicated via email to info@timelessphotoshoot.com at least 7 days before the scheduled start time of the service entitles the User to a full refund of amounts paid to the Platform. If the notification is received between 7 days and 24 hours before the service start time, the Platform will retain 30% of the service price. In the case of a photoshoot with a Gondola Trip (30 minutes), the Platform will retain 30% of the service price as well as the cost of the Gondola service (€150).
3.5 SUBSTITUTIONS A User who wishes to withdraw may be replaced by another person, provided that: a) The organizer is informed in writing at least 4 business days before the scheduled start date of the service, along with the reason for the substitution and the transferee’s details;
b) The transferee meets all conditions required to use the service (per Art. 89 of the Consumer Code), including passport, visa, and health certificate requirements;
c) The substitute reimburses the organizer for any additional expenses incurred due to the substitution, as determined before the transfer.
The original and substitute User are jointly responsible for the full payment of the price as well as the amounts indicated in letter (c) of this article. Further terms and conditions for substitutions are specified in the technical sheet.
Art. 4 – Other Rights of Timelessphotoshoot.com
4.1 Timelessphotoshoot.com may cancel an activity on the agreed date without prior notice if weather conditions, government measures, strikes, or other external and unpredictable circumstances beyond the control of the Photographer (including force majeure events) make it impossible or significantly more difficult to carry out the activity. In this case, the amount paid for the canceled activity will be refunded. The User may address any claims directly to the Platform.
4.2 The Platform is not responsible for any damages resulting from fraudulent or negligent behavior by the assigned photographers or third parties during the execution of the Service.
4.3 The Photographer may exclude the User from an activity if they fail to meet safety, legal, or decorum requirements. In such cases, the amount paid for the activity will not be refunded.
4.4 The Photographer may make minor changes to the program if necessary due to short-term circumstances. Insignificant program changes include relocating the meeting point, provided that the new location is reachable within 15 minutes on foot or via public transport from the originally agreed-upon location. Changes to the meeting point are possible up to 24 hours before the booked activity and will be communicated via email, SMS, or WhatsApp.
4.5 Price variations may apply due to extraordinary events such as increased costs for access tickets, supply costs, or other factors. Any increases will be communicated to the User promptly.
Art. 5 – Obligations of the Platform
The Platform agrees to:
- Provide the requested Service at the dates and times selected by the User during purchase;
- Ensure the employment of qualified photographers who meet the Platform’s quality standards;
- Promptly communicate any variations or impossibilities to execute the Service due to force majeure. The Platform is not responsible for delays or failures resulting from circumstances beyond its direct control, including actions by the User or third parties.
Art. 6 – Descriptions and Information
The descriptions, information, and illustrations published on the Platform are provided in good faith based on the indications and documents received under the responsibility of their authors. Temporary closures of certain attractions due to maintenance work or technical issues are always possible; likewise, weather conditions may sometimes lead to the cancellation of certain activities.
Additionally, the dates and locations of exhibitions or events mentioned in this brochure may be subject to change by the organizer without prior notice.
The classification of accommodation facilities selected in the brochure is based on the official standards of the Italian Ministry of Tourism.
Art. 7 – User Obligations
The User agrees to:
- Provide correct and complete information when booking the Service;
- Arrive at the designated location, date, and time for the Service;
- Comply with the terms and conditions specified in this contract and on the Platform.
Failure to appear or canceling less than 24 hours before the scheduled time will not entitle the User to a refund.
Art. 8 – Copyright and Use of Images
All copyrights related to images produced during the photography Service are exclusively transferred to the Platform.
The User agrees that the images may be used by the Platform for promotional or commercial purposes unless the User provides explicit written consent stating otherwise.
The User is granted personal, non-commercial use of the provided images.
Art. 9 – Applicable Law and Jurisdiction
This contract is governed by Italian law, particularly the Civil Code and the Consumer Code (Legislative Decree 206/2005). For disputes regarding interpretation, execution, or termination of this contract, the jurisdiction lies exclusively in the User’s place of residence if within Italy. If the User resides outside Italy, the competent court will be in Latina.
Art. 10 – Right of Withdrawal
10.1 The User, if classified as a consumer, has the right to withdraw from the contract without providing any reasons within 14 days from the contract’s conclusion.
10.2 The right of withdrawal is excluded in the following cases:
– Services that have been fully performed before the withdrawal period expires if execution started with the consumer’s explicit agreement;
– Services whose execution began, with the consumer’s consent, before the withdrawal period ended;
– Booking services for a specific date when the consumer has expressly requested service execution for that date.
10.3 To exercise the right of withdrawal, the User must inform the Platform of their decision through an explicit statement sent before the withdrawal period expires via:
– Email to: info@timelessphotoshoot.com
– Registered mail with acknowledgment of receipt to the legal address
10.4 If the withdrawal is validly exercised, the Platform will refund all payments received from the User without undue delay and within 14 days from the date it was informed of the withdrawal decision. The refund will be made using the same payment method used by the User for the initial transaction unless otherwise agreed.
CONTRATTO DI FORNITURA DI SERVIZI FOTOGRAFICI ONLINE
Timelessphotoshoot.com, con sede legale in Via Segantini – Latina – 04100 Italia, P.IVA 03077740599, di seguito denominata “Piattaforma”, e l’Utente, identificato tramite le credenziali fornite al momento dell’acquisto del servizio sulla Piattaforma, stipulano il seguente contratto in modalità elettronica.
L’accettazione del presente contratto avviene mediante la spunta della casella “Accetto i termini e le condizioni”, resa disponibile al momento dell’acquisto del servizio sulla Piattaforma.
Premessa
Per accedere alla Piattaforma, l’utente deve registrarsi per poter utilizzare di tutte le funzionalità, come modifica degli acquisti, riepilogo ordini, etc.
Per registrarsi e creare un account, l’utente deve inserire il proprio nome e cognome, l’indirizzo e-mail ed impostare una password all’interno della sezione “Customer Information” mostrata durante il processo di acquisto di un servizio fotografico. Questi dati vanno mantenuti segreti, in modo che nessun altro abbia accesso all’account dell’utente.
L’utente può modificare la password, le informazioni fornite e la prenotazione accedendo in ogni momento alla piattaforma attraverso il pulsante di login situato nel footer del sito (sia da web che mobile).
Art. 1 – Oggetto del contratto
La Piattaforma offre agli Utenti la possibilità di acquistare servizi fotografici personalizzati (di seguito, “Servizi”) nelle città d’arte indicate sul sito web.
L’Utente seleziona il tipo di Servizio richiesto, la data, l’orario e la città disponibili sulla Piattaforma al momento della prenotazione.
Il Servizio sarà eseguito da fotografi freelance selezionati dalla Piattaforma e incaricati per l’esecuzione del Servizio acquistato dall’Utente.
L’Utente può scegliere il servizio desiderato direttamente sulla Piattaforma al momento della prenotazione.

Art. 2 – Modalità di acquisto e pagamento
L’acquisto del Servizio avviene esclusivamente online tramite la Piattaforma, previa registrazione dell’Utente ed accettazione del presente contratto, che avvengono entrambe durante il processo di acquisto all’interno della sezione “Customer Information”.
Il prezzo del Servizio è indicato chiaramente al momento della selezione e può variare in base al tipo di servizio fotografico scelto, alla città e alla durata del Servizio.
Il pagamento avviene tramite i metodi di pagamento accettati dalla Piattaforma (es. carta di credito, PayPal).
La conferma del pagamento equivale all’accettazione definitiva della prenotazione del Servizio.
Art. 3 – Modifiche e cancellazioni
3.1 L’utente potrà solo cancellare i contratti di servizio in conformità alle condizioni di annullamento riportate nella descrizione dell’attività sulla piattaforma.
3.2 Per evitare fraintendimenti, l’utente dovrà apportare modifiche (ad esempio un rinvio della data dell’attività) e annullamenti mediante la Piattaforma, se non diversamente concordato.
3.3 Un annullamento può aver luogo attraverso l´invio di una email a info@timelessphotoshoot.com La modifica o l’annullamento deve avvenire tempestivamente. Il concetto di “tempestivamente” non dipende solo dal rispettivo caso singolo (ad esempio entro il termine di annullamento vigente) ma può anche dipendere dalla disponibilità dell’attività. Pertanto, è molto importante leggere attentamente tutte le condizioni. Il fattore decisivo per la tempestività dello storno è la ricezione della notifica da parte di timelessphotoshoot.com entro i termini stabiliti. Se queste condizioni sono soddisfatte, emetteremo una conferma di annullamento o di modifica.
Questa è anche una prova dell’annullamento e della modifica e deve quindi essere conservata.
3.4 L’annullamento, comunicato via email ad info@timelessphotoshoot.com, entro 7gg dalla data ed ora di inizio del servizio dà diritto a ricevere il rimborso delle somme versate alla piattaforma.
Se tale comunicazione arriva tra 7gg e 24ore dall’inizio del servizio la piattaforma tratterà il 30% del prezzo del servizio stesso. Nel caso di servizio fotografico con Gondola Trip (30min) la piattaforma tratterà il 30% del prezzo del servizio stesso nonché´ il prezzo del servizio Gondola (€150).
3.5 SOSTITUZIONI
Il consumatore rinunciatario può farsi sostituire da altra persona sempre che:
a) l’organizzatore ne sia informato per iscritto almeno 4 giorni lavorativi prima della data fissata per l’inizio del servizio, ricevendo contestualmente comunicazione circa le ragioni della sostituzione e le generalità del cessionario;
b) il cessionario soddisfi tutte le condizioni per la fruizione del servizio (ex art. 89 Cod. Cons.) ed in particolare i requisiti relativi al passaporto, ai visti, ai certificati sanitari;
c) il sostituto rimborsi all’organizzatore tutte le spese aggiuntive sostenute per procedere alla sostituzione, nella misura che gli verrà quantificata prima della cessione.
Il cedente ed il cessionario sono solidalmente responsabili per il pagamento del saldo del prezzo nonché degli importi di cui alla lettera c) del presente articolo.

Art. 4 – Altri diritti di timelessphotoshoot.com
4.1 Timelessphotoshoot.com può cancellare l’attività alla data concordata senza rispettare un termine di preavviso se le condizioni meteorologiche, misure stabilite dalle autorità, scioperi o altre circostanze esterne e imprevedibili o che possono essere evitate solo con sforzi sproporzionati da parte del Fotografo e che sono fuori dal controllo di timelessphotoshoot.com (in particolare eventi di forza maggiore) rendono impossibile o notevolmente più difficile o mettono in pericolo lo svolgimento dell’attività. In questo caso, il prezzo di prenotazione pagato per l’attività cancellata sarà rimborsato. L’utente potrà indirizzare eventuali richieste di risarcimento direttamente alla Piattaforma.
4.2 La Piattaforma non sarà responsabile per eventuali danni derivanti da comportamenti dolosi o colposi dei fotografi incaricati o di terze parti durante l’esecuzione del Servizio.
La Piattaforma non garantisce la disponibilità del Servizio in caso di eventi imprevisti o di forza maggiore (es. maltempo, scioperi, restrizioni governative).
4.3 Il Fotografo può escludere l’utente da un’attività se l’utente non soddisfa i requisiti di partecipazione necessari in termini di sicurezza, legalità, decoro. In questi casi, il prezzo di prenotazione pagato per l’attività non sarà rimborsato.
4.4 Il Fotografo può apportare piccole modifiche al programma in qualsiasi momento se questo appare necessario a causa di circostanze che si verificano a breve termine. I cambiamenti di programma insignificanti includono anche un cambiamento nel punto di partenza/di incontro del tour, a condizione che il nuovo punto di incontro possa essere raggiunto dal cliente entro 15 minuti a piedi o con i mezzi pubblici dal punto di incontro originariamente concordato. Un cambiamento del punto di partenza/di incontro è possibile fino a 24 ore prima dell’inizio dell’attività prenotata e ti sarà comunicato via e-mail, sms o whatsapp.
4.5 Potranno essere applicate variazioni di prezzo a causa di eventi straordinari quali aumento costo ticket per aree soggette a pass a pagamento, aumento dei costi delle forniture, altro. Detti aumenti saranno comunicati tempestivamente all’utente.
Art. 5 – Obblighi della Piattaforma
La Piattaforma si impegna a:
- Fornire il Servizio richiesto dall’Utente nelle modalità, date e orari selezionati al momento dell’acquisto;
- Garantire l’impiego di fotografi qualificati che rispettino gli standard qualitativi stabiliti dalla Piattaforma;
- Comunicare tempestivamente eventuali variazioni o impossibilità di eseguire il Servizio per cause di forza maggiore.
La Piattaforma non è responsabile di eventuali ritardi o inadempimenti derivanti da cause non imputabili direttamente alla stessa, inclusi comportamenti dell’Utente o di terze parti.
Art. 6 – Descrizione e Informazioni
Le descrizioni, informazioni e illustrazioni pubblicate nella Piattaforma, sono fornite in buona fede sulle indicazioni e sui documenti che ci sono stati forniti sotto la responsabilità dei loro autori. Le chiusure temporanee di certe attrazioni dovute a lavori temporanei, delle mancanze tecniche sono sempre possibili; allo stesso modo anche le condizioni meteorologiche possono a volte provocare
l’annullamento di certe attività.
Dall’altra parte, le date e i luoghi d’esposizione o di feste menzionati nella presente brochure possono essere soggette a modifiche da parte dell’organizzatore anche senza preavviso.
La classificazione delle strutture ricettive selezionate nella brochure è stabilita in funzione delle norme ufficiali del Ministero del Turismo Italiano.
Art. 7 – Obblighi dell’Utente
L’Utente si impegna a:
- Fornire informazioni corrette e complete durante la fase di prenotazione del Servizio (Contact Information);
- Presentarsi nel luogo, data e orario stabiliti per lo svolgimento del Servizio;
- Rispettare i termini e le condizioni specificate nel presente contratto e nella Piattaforma.
In caso di mancata presentazione o di cancellazione tardiva (meno di 24 ore prima dell’orario prenotato), l’Utente non avrà diritto ad alcun rimborso.
Art. 8 – Diritti d’autore e utilizzo delle immagini
Tutti i diritti d’autore relativi alle immagini prodotte durante il Servizio fotografico sono ceduti esclusivamente alla Piattaforma.
L’Utente accetta che le immagini possano essere utilizzate dalla Piattaforma per finalità promozionali o commerciali, salvo specifico consenso scritto fornito dall’Utente.
L’Utente avrà diritto all’uso personale e non commerciale delle immagini fornite.
Art. 9 – Legge applicabile e foro competente
Il presente contratto è regolato dalla legge italiana, in particolare dalle disposizioni del Codice Civile e del Codice del Consumo (D.Lgs. 206/2005).
Per qualsiasi controversia relativa all’interpretazione, esecuzione o risoluzione del presente contratto, sarà competente in via esclusiva il foro del luogo di residenza o domicilio dell’Utente se ubicato nel territorio italiano. Tale disposizione è inderogabile ai sensi dell’art. 33, comma 2, lett. u) del Codice del Consumo. Qualora l’Utente non sia residente in Italia o non abbia domicilio nel territorio italiano, sarà competente il Foro di Latina.
Art. 10 – Diritto di recesso
10.1 L’Utente che riveste la qualifica di consumatore ha il diritto di recedere dal contratto, senza indicarne le ragioni, entro 14 giorni dalla conclusione del contratto stesso.
10.2 Il diritto di recesso è escluso nei seguenti casi:
– servizi completamente eseguiti prima della scadenza del periodo di recesso, se l’esecuzione è iniziata con l’accordo espresso del consumatore;
– servizi la cui esecuzione sia iniziata, con l’accordo del consumatore, prima della scadenza del termine di recesso;
– servizi di prenotazione per una data specifica, quando il consumatore ha espressamente richiesto l’esecuzione del servizio per tale data.
10.3 Per esercitare il diritto di recesso, l’Utente deve informare la Piattaforma della sua decisione mediante una dichiarazione esplicita da inviare prima della scadenza del periodo di recesso tramite:
– email all’indirizzo: info@timelessphotoshoot.com
– raccomandata A/R all’indirizzo della sede legale
10.4 In caso di recesso validamente esercitato, la Piattaforma rimborserà tutti i pagamenti ricevuti dall’Utente, senza indebito ritardo e comunque entro 14 giorni dal giorno in cui è stata informata della decisione di esercitare il recesso. Il rimborso sarà effettuato utilizzando lo stesso mezzo di pagamento usato dall’Utente per la transazione iniziale, salvo diverso accordo.
